10.17.2007 // Jason Luck obtains Summary Judgment for Insurer
Attorney Jason Luck, representing one of the firm's excess and surplus lines insurer clients, prevailed in a coverage action in the Florence Division of the United States District Court of South Carolina. The Plaintiff was the victim of a shooting on the premises of the insured nightclub and he sought declaratory judgment in a direct action against the carrier. The Court agreed with our client that the Assault and Battery Exclusion meant that no coverage was afforded to the nightclub for the incident as alleged in the underlying negligence action.
